1. Acceptance of Terms

By accessing or using the CatchIt! Discovery application for macOS, the CatchIt! Listen application for iOS, or the catchit.io website (collectively, the "Service"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

3. Account Registration

The Service is currently in an invitation-only beta phase. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Each person may maintain only one account.

4. The Service

CatchIt! provides tools for DJ set tracking, music discovery via audio recognition, tracklist import, music search and playback through streaming platforms, library management, and cloud synchronization. The Service is provided "as-is" and may change as we continue to develop it.

5. Pricing

The Service is currently free to use. We may introduce paid features in the future. If we do, we will provide reasonable notice before any pricing changes take effect.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose.
  • Attempt to access another user's account or data.
  • Reverse engineer, decompile, or disassemble the applications.
  • Use automated means to scrape, crawl, or extract data from the Service.
  • Interfere with or disrupt the Service or its servers.

7. Temporary Audio Processing

The applications may temporarily download and process audio files solely for music recognition purposes. These temporary files are protected by multiple layers of security and automatically deleted after processing.

You must not attempt to access, copy, distribute, or retain these temporary audio files. Any attempt to circumvent these protections is a violation of these Terms, and you are solely responsible for any legal consequences that may result from such actions.

8. Intellectual Property and Copyright

  • CatchIt! and all associated trademarks, logos, and application code are owned by the developer.
  • Music metadata displayed in the apps belongs to the respective rights holders.
  • You are solely responsible for ensuring your use of the Service complies with applicable copyright and intellectual property laws.
  • We do not host, distribute, or facilitate permanent access to copyrighted audio content.

9. User Content

You retain ownership of any data you provide, such as notes and track classifications. By using the Service, you grant us a limited, non-exclusive license to store and synchronize your data solely for the purpose of providing the Service to you.

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. To request account deletion and removal of all your data, email support@catchit.io.

11. Third-Party Services

The Service integrates with third-party platforms including Supabase, Apple ShazamKit, Spotify, and Apple Music. Your use of those services is subject to their respective terms and conditions. We are not responsible for the practices of third-party services.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times, particularly during the beta period.

13. Limitation of Liability

To the maximum extent permitted by applicable law, CatchIt! and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, particularly during the beta period. You may stop using the Service at any time.

15. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects when the latest changes were made. Your continued use of the Service after any changes constitutes acceptance of the updated terms.

16. Governing Law

These Terms shall be governed by applicable law. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation before pursuing any other remedies.
